Release of Liability, Assumption of Risk & Indemnity Agreement

This is the agreement every Bozzi user accepts when creating an account in the app. It is reproduced here for reference, exactly as accepted.

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE AND YOUR RIGHT TO A JURY TRIAL. BY TAPPING “I AGREE,” CREATING AN ACCOUNT, OR USING BOZZI, YOU ACCEPT THIS AGREEMENT.

1. Bozzi is only a platform

The Bozzi app (“App”) is operated by Cheyenne Fakouri, an individual doing business as "Bozzi" (“Bozzi,” “we,” “us”). The App helps people discover, organize, join, and communicate about recreational sports activities (“Games”). We do not organize, host, sponsor, supervise, officiate, or control Games. We do not own, operate, inspect, or maintain any venue, field, or court. We do not provide equipment, referees, security, or medical support, and we do not conduct background checks or otherwise vet users, hosts, or venues. Hosts and players are independent individuals acting on their own behalf — they are not our employees, contractors, or agents. Any information in the App (including attendance, reliability scores, check-ins, or player statistics) is provided for convenience only and is not a representation about any person's character, skill, or safety.

2. Voluntary participation and assumption of risk

Sports and physical activities are inherently dangerous. Risks include, without limitation: falls; collisions with people, equipment, or surfaces; overexertion; heat- or cold-related illness; cardiac events; cuts, broken bones, concussion, paralysis, and DEATH; defective or poorly maintained venues and equipment; weather; travel to and from Games; and the negligent, reckless, or criminal conduct of other participants or third parties. YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS arising out of or relating to any Game or related activity you find, join, organize, or attend through the App, whether or not listed above, and whether caused in whole or in part by the negligence of a Released Party (defined below).

3. Fitness and medical responsibility

You represent that you are physically able to participate safely and have consulted a physician about any condition that could make participation unsafe. Bozzi provides no medical advice or emergency services.

4. RELEASE AND WAIVER OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE CHEYENNE FAKOURI, AN INDIVIDUAL DOING BUSINESS AS "BOZZI", AND ANY SUCCESSOR ENTITY, TOGETHER WITH THEIR RESPECTIVE OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, AND ASSIGNS (THE “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, LIABILITIES, DEMANDS, DAMAGES, LOSSES, COSTS, AND CAUSES OF ACTION OF ANY KIND ARISING OUT OF OR RELATING TO: (a) ANY GAME OR ACTIVITY FOUND, ORGANIZED, JOINED, OR COMMUNICATED ABOUT THROUGH THE APP; (b) THE ACTS OR OMISSIONS OF ANY USER, HOST, VENUE, OR OTHER THIRD PARTY; OR (c) THE CONDITION OF ANY VENUE OR EQUIPMENT — INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. This release does not extend to liability that cannot be waived under applicable law.

5. Indemnification

You will indemnify, defend, and hold harmless the Released Parties from any third-party claim (including reasonable attorneys' fees) arising out of your participation in any Game, your conduct toward other users, content you post, or your violation of this Agreement or applicable law.

6. No warranties

The App is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including fitness for a particular purpose and any warranty regarding the conduct of users or the safety of Games or venues.

7. Limitation of liability

To the fullest extent permitted by law: (a) no Released Party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or data; and (b) the Released Parties' total aggregate liability for all claims relating to the App will not exceed the greater of $100 or the amounts you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations; in those, this section applies to the maximum extent permitted.

8. Arbitration and class-action waiver

Any dispute arising out of this Agreement or the App that cannot be resolved informally will be resolved by BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association under its Consumer Arbitration Rules, in the California county of our principal place of business or by video conference at your election. YOU AND BOZZI EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Either party may instead bring an individual claim in small-claims court. You may opt out of this arbitration section by emailing nextup.lfm@gmail.com within 30 days of first accepting this Agreement.

9. Eligibility

You must be at least 18 years old to create an account or use the App. By accepting this Agreement you represent that you are at least 18. If a Game's age settings permit minors to attend with you, you accept this Agreement on the minor's behalf to the fullest extent permitted by law and assume all risks on their behalf.

10. General

This Agreement is governed by the laws of the State of California, without regard to conflict-of-law rules. If any provision is held unenforceable, it will be narrowed to the minimum extent necessary and the remainder stays in effect. Sections 2–8 survive account deletion. We may update this Agreement; material changes require your renewed acceptance before continued use. Your electronic acceptance (checkbox and tap) is your signature, and you consent to electronic records.
