Terms of Service

These Terms of Service ("Terms") govern your use of the Bozzi mobile application ("Bozzi," "the app," "we," "us"), operated by Cheyenne Fakouri, an individual doing business as "Bozzi" ("the operator"). By creating an account or using Bozzi, you agree to these Terms and to the Release of Liability, Assumption of Risk & Indemnity Agreement you accept in the app. If you do not agree, do not use the app.

1. Eligibility

You must be at least 18 years old to create an account or use Bozzi. By using the app, you represent that you are 18 or older and that the information you provide is accurate.

2. Your account

You are responsible for your account and for keeping your login credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at support@bozzisports.com if you suspect unauthorized use.

3. What Bozzi does

Bozzi helps people find, schedule, and join pickup sports games—both one-off and recurring—run recreational leagues, and coordinate with friends and groups through messaging and shared game activity. Bozzi is only a platform: we do not organize, host, supervise, or control games, venues, or players, and we do not screen users. You are responsible for your own conduct, safety, and decisions when arranging or attending any game or meeting other users in person.

4. Release of liability and assumption of risk

Participation in sports is inherently risky. As part of creating an account, you accept the Release of Liability, Assumption of Risk & Indemnity Agreement, which is incorporated into these Terms by reference. It includes a release of claims, an assumption of risk, an indemnity, and an arbitration and class-action waiver. Please read it.

5. Acceptable use and zero tolerance for objectionable content

Bozzi has a zero-tolerance policy for objectionable content and abusive behavior. Content or conduct that violates these Terms may be removed, and offending accounts may be suspended or terminated, without notice.

When using Bozzi, you agree that you will not:

Post, send, or share content that is harassing, threatening, abusive, hateful, defamatory, obscene, sexually explicit, or otherwise objectionable.
Bully, intimidate, stalk, or harass any other user.
Post content that promotes violence, discrimination, or illegal activity, or that endangers anyone's safety.
Impersonate any person or misrepresent your identity or affiliation.
Share content that infringes anyone's intellectual property, privacy, or other rights.
Use the app to spam, scam, or distribute malware.
Attempt to access, disrupt, or interfere with the app, its systems, or other users' accounts.
Collect or harvest other users' information without their consent.

You are solely responsible for the content you post and the messages you send.

6. Reporting, blocking, and enforcement

Bozzi provides tools to report objectionable content, messages, or users, and to block users so they can no longer interact with you. We review reports and act on violations of these Terms within a reasonable time, including by removing content and suspending or terminating offending accounts.

To report a concern directly, contact support@bozzisports.com. We may take action on any content or account that violates these Terms at our discretion. We do not tolerate users who engage in abusive behavior toward others.

7. Your content

You retain ownership of the content you create in Bozzi (such as messages, profile information, and game details). By posting content, you grant Bozzi a non-exclusive, worldwide, royalty-free license to host, store, display, and share that content as necessary to operate and provide the app's features (for example, delivering your messages to their intended recipients or showing your games to relevant users). This license ends when your content or account is deleted, except for content already shared with others or where we must retain it to comply with the law.

8. Suspension and termination

We may suspend or terminate your access to Bozzi at any time, with or without notice, if you violate these Terms, engage in objectionable conduct, or create risk or legal exposure for us or other users. You may stop using Bozzi at any time and delete your account in the app (Settings → Delete Account) or by contacting support@bozzisports.com.

9. Disclaimers

Bozzi is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure. Bozzi helps coordinate games and connections between users, but we are not responsible for the conduct of any user, the safety of any game or venue, or any interaction that occurs in person or online. You participate in games and interact with other users at your own risk.

10. Limitation of liability

To the fullest extent permitted by law, the operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, injury, or harm arising out of or related to your use of Bozzi, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages. Your sole remedy for dissatisfaction with the app is to stop using it. Additional limitations, releases, and an arbitration agreement appear in the Release of Liability agreement.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of Bozzi after changes take effect means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Disputes arising out of these Terms or your use of Bozzi are resolved by binding individual arbitration (with a small-claims option) as set out in the Release of Liability, Assumption of Risk & Indemnity Agreement. Where a dispute is not subject to that arbitration agreement, it will be subject to the exclusive jurisdiction of the state and federal courts located in California.
